CONSENT CLAUSES

Quote My Car (Pty) Ltd (“QMC”) Version: 1.0 Effective Date: 27/11/2025


1. General POPIA Consent

By using the QMC platform, creating an account, or participating in an auction, you consent to the collection and processing of your personal information by Quote My Car (Pty) Ltd, for lawful purposes connected to providing marketplace and auction services.


2. Consent for Account Creation & Platform Use

By clicking “Create Account”, you confirm that you consent to QMC processing:

  • Your name and contact details
  • Your account login information
  • Your platform activity and usage logs
  • Communications required to operate your auction account

3. Consent for KYC (Identity Verification)

By registering as a public bidder, you consent to the processing of:

  • Your ID number
  • Copy of your ID or passport
  • Proof of address
  • Facial recognition or liveness verification (if applicable)

You acknowledge that this verification is necessary to prevent fraud, fake bidding, and price manipulation.


4. Consent for Bank Account Verification

By submitting your banking details, you consent to QMC:

  • Validating account ownership
  • Using approved third-party verification providers
  • Retaining verification logs for compliance and audit purposes

Your banking details will never be used to perform unauthorised transactions.


5. Consent for Bidder Deposit Processing

By participating in public auctions, you consent that QMC may:

  • Receive and validate your refundable auction deposit
  • Store proof of deposit and refund records
  • Use deposit information to determine auction eligibility
  • Retain transaction records in line with legal requirements

6. Consent to Fraud Prevention & Behavioural Analysis

You consent to QMC using automated and manual fraud-prevention systems, including:

  • Device and browser fingerprinting
  • IP and geolocation checks
  • Behavioural analysis
  • Detection of suspicious or irregular bidding actions
  • Automated systems to detect fake or manipulated bidding

These measures protect the integrity of the auction platform.


7. Consent for Communications

7.1 Essential Communications (Mandatory)

You consent to receiving:

  • Bid confirmations
  • Auction updates
  • Account and security alerts
  • Regulatory or compliance notifications

7.2 Marketing Communications (Optional)

With optional consent, you may receive:

  • Platform promotions
  • Dealer promotions
  • Product updates
  • Newsletters

You may opt out of marketing at any time.


8. Consent for Information Sharing

You consent to QMC sharing relevant information with:

  • Motor dealers (for sellers listing vehicles)
  • Buyers or sellers finalising transactions
  • KYC and verification providers
  • Payment processors
  • Courier or operational partners (if applicable)

Only the minimum necessary information is shared.


9. Consent for Storage & Retention

You consent to QMC retaining your personal information in line with:

  • POPIA
  • FICA (where applicable)
  • QMC’s Data Retention & Destruction Policy

Typical retention periods include:

  • KYC & bank verification: 5–7 years
  • Auction logs & bid history: 5 years
  • Financial records: 5 years

10. Consent for Cross-Border Data Transfers

If QMC uses international cloud hosting or service providers, you consent to:

  • Secure transfer of your personal data outside South Africa
  • Storage in jurisdictions with adequate data protection safeguards
  • POPIA-compliant agreements with all international providers

11. Withdrawal of Consent

You may withdraw consent for optional processing at any time by contacting:

support@qmcars.co.za

Withdrawal does not affect:

  • Completed auction records
  • Legally required KYC retention
  • Bank verification history
  • QMC’s compliance obligations

12. Acceptance

By creating an account, submitting information, or using the QMC platform, you confirm that:

  • You understand these consent terms
  • You voluntarily provide your personal information
  • You consent to the purposes described above
  • You understand QMC’s POPIA Privacy Policy and Processing Notice
